A local business owner filed a complaint last week alleging that Burkett Outdoor Advertising digital billboards located in downtown San Antonio had violated state ethics laws. These included those regarding the purchase of ad spaces. Jim Persons filed the complaint, who supports the downtown ballpark project.

The signs violated state law, according to the business owner. They do not contain a TEC right of way notice and they did not disclose the fact that Tim Benson bought the ad space. Also, the owner claims that the ads are not clear that they were paid for by the campaign.
TEC Rejects Businessowner's TEC Complaint
Persons filed a complaint against TEC on October 12. In a statement, the commission stated that the complaint was due to technical errors.
In its rejection letter, TEC cited "simple error" in the advertising information. The TEC said that the information on Benson's purchase of the ad space is difficult to understand and does not contain a TEC right to-of way statement, as required in law.
It is not clear if these errors are serious. Reporters reached out to the TEC Wednesday but they did not respond.

Unconstitutional is the City's Sign Ordinance
This case centers on the constitutionality and legality of an ordinance by Salter that requires him to get permits to place off-premises advertising signs. Salter specifically challenges the City’s municipal Code (the "Ordinance") that regulates the location, size of advertising signs outside. The court is charged with determining whether or not the Ordinance is valid as applied. The court will need to consider evidence that the Ordinance favors commercial advertisements over those not.
